1. Introduction

Welcome to Preloved Bookshop (“we”, “our”, “us”). These Terms and Conditions govern your use of our website and services available at https://prelovedbookshop.com.au (“Site”). By accessing or using our Site, you agree to be bound by these Terms.

Preloved Bookshop provides an online marketplace that connects independent vendors (“Vendors”) with buyers (“Buyers”) for the sale of second-hand and new books. We facilitate payments and provide tools for communication, but we are not a party to the contract of sale between buyers and vendors.

2. Use of the Site

You must be at least 18 years old to create an account or register as a Vendor.
You agree not to use the Site for any unlawful or prohibited purpose.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You must not use the Site to spam, solicit, or direct users to other websites or platforms to complete a sale outside of Preloved Bookshop.
Any attempt to circumvent the platform, including redirecting buyers to external payment methods or marketplaces, will result in immediate account suspension or termination.
Other prohibited conduct includes phishing, harvesting user data, or transmitting malicious code.

3. Account Registration

Users may register as Buyers or Vendors. When creating an account, you agree to provide accurate, current, and complete information. We reserve the right to suspend or terminate accounts that breach these Terms or where information provided is found to be inaccurate or misleading.

We reserve the right to request additional information to verify your identity or the nature of your selling activity before approving a Vendor account.

4. Marketplace Role and Responsibility

Preloved Bookshop acts solely as a platform provider. We do not own, create, or inspect any listings or products sold by Vendors, and we do not guarantee the legality, quality, or accuracy of any Vendor’s content or products. Any contract of sale is directly between the Buyer and Vendor. We are not liable for any loss, damage, or dispute arising from such transactions.

Preloved Bookshop is a niche marketplace focused exclusively on books and related literary items.

5. Vendor Listings and Responsibilities

Vendors are independent sellers responsible for the accuracy of their listings and for fulfilling orders placed through the marketplace.
Vendors must set and clearly display their own shipping, refund, and warranty policies on their Vendor pages.
Preloved Bookshop is designed for individual sellers, small-scale vendors, and authors. It is not intended for bulk resellers or high-volume commercial retailers. Vendor accounts that appear to operate primarily as retail outlets, or that list mass quantities of stock typical of large-scale businesses, may be declined or removed at our discretion.
Vendors must ensure that their policies and conduct comply with the Australian Consumer Law.
Preloved Bookshop reserves the right to remove listings or suspend Vendor accounts that breach legal or ethical standards.

6. Vendor Payouts and Balances

Vendor earnings are held within the Preloved Bookshop platform until the minimum withdrawal threshold is met. Once eligible, Vendors may request a withdrawal through PayPal. PayPal transaction fees will be shared equally between Preloved Bookshop and the Vendor (50/50 split).

Withdrawals may be subject to processing times, verification, and compliance checks. Preloved Bookshop reserves the right to delay or withhold payments in cases of suspected fraud, disputes, or account irregularities.

7. Buyer Responsibilities

Buyers are responsible for reading all item descriptions and Vendor policies before making a purchase.
All payments must be made through the Site’s approved payment methods.
Buyers agree to communicate directly with Vendors regarding any questions, issues, or disputes related to an order.

8. Payment Processing

Payments are securely processed through PayPal. Some payment and transaction data will be shared with PayPal for the purpose of completing your transaction. For details, please refer to the PayPal Privacy Policy.

9. Dispute Resolution Between Buyers and Vendors

Preloved Bookshop provides tools within the Vendor Dashboard to facilitate communication and resolution of disputes between Buyers and Vendors. All disputes must be resolved directly between the two parties. Preloved Bookshop does not mediate, arbitrate, or enforce resolutions, and assumes no liability for outcomes of disputes.

10. Vendor and Buyer Communication

Users may communicate through the platform’s messaging and dispute tools. Preloved Bookshop may access these communications if required to ensure compliance with marketplace policies or to investigate reports of misuse. Users are strictly prohibited from sharing personal data obtained through transactions for purposes outside order fulfilment unless explicit consent is given.

11. Reviews and Feedback

Buyers may leave feedback or reviews for Vendors. Preloved Bookshop reserves the right to moderate, edit, or remove reviews that are defamatory, abusive, irrelevant, or violate our policies.

12. Intellectual Property

All content on this Site, including text, graphics, logos, and layout, is the property of Preloved Bookshop or its content suppliers and is protected by copyright law. Vendors retain ownership of their product descriptions and images but grant Preloved Bookshop a non-exclusive licence to display and promote their listings.

13. Limitation of Liability

To the fullest extent permitted by law, Preloved Bookshop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Site or any transaction between Buyers and Vendors.

14. Termination

We may suspend or terminate your account at any time, without notice, if you breach these Terms or engage in fraudulent, abusive, or illegal behaviour.

15. Changes to These Terms

Preloved Bookshop reserves the right to update or modify these Terms at any time. Continued use of the Site following any such changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
